2.1. Conditions for use
The 3.4-3.6 GHz frequency band has to be used according to the channelling plan of CEPT recommendation CEPT/ERC/RECOMMENDATION/14-03 (Annex B).
The capacity allocated to an operator is limited to 25 MHz duplex. Therefore, a maximum of two operators can be authorised within one geographic area.
No guardband is provided for between both operators.
The FDD and TDD technologies are allowed.
2.2. Fees for the use of the frequencies
For the year 2005 the annual fee per base station is 335 euro per MHz duplex allocated to the base station.
That amount is readjusted annually based on the consumer price index.
2.3. Licences
Two operators have a licence to use the wireless local loop in the 3.4-3.6 GHz frequency band :
· ClearWire Belgium (since 5 April 2004) ;
· Mac Telecom (since 15 April 2004).
No spectrum is available anymore in the 3.4-3.6 GHz frequency band.
3. 10.15-10.65 GHz frequency band
3.1. Conditions for use
The 10.15-10.65 GHz frequency band has to be used according to the channelling plan of CEPT recommendation CEPT/ERC/RECOMMENDATION/12-05.
The capacity allocated to an operator is limited to 56 MHz duplex. Therefore, a maximum of two operators can be authorised within one geographic area.
A 28 MHz guardband is set between both operators. This guardband could be used by the operators based on a bilateral agreement.
The FDD and TDD technologies are allowed.
3.2. Fees for the use of the frequencies
For the year 2005 the annual fee per base station is 153 euro per MHz duplex allocated to the base station.
That amount is readjusted annually based on the consumer price index.
3.3. Licences
Since 22 November 2004 Mac Telecom has a licence to use the wireless local loop in the 10.15-10.65 GHz frequency band.
Spectrum is still available for a licence for the entire Belgian territory in the 10.15-10.65 GHz frequency band.
4. 24.5–26.5 GHz frequency band
4.1. Conditions for use
The 24.5-26.5 GHz frequency band has to be used according to the channelling plan of CEPT recommendation T/R 13-02 (Annex B).
The capacity allocated to an operator is limited to 56 MHz duplex.
The FDD and TDD technologies are allowed.
4.2. Fees for the use of the frequencies
For the year 2005 the annual fee per base station is 82 euro per MHz duplex allocated to the base station.
That amount is readjusted annually based on the consumer price index.
4.3. Licences
The MET (Walloon Region) has a licence to use the wireless local loop (only in the municipality of Charleroi) in the 24.5-26.5 GHz frequency band since 29 August 2001.
BIPT has decided not to grant any new WLL licences in the 24.5-26.5 GHz frequency band, as long as spectrum is still available in the 27.5-29.5 GHz frequency band.
5. 27.5–29.5 GHz frequency band
5.1. Conditions for use
The use of the 27.5-29.5 GHz frequency band is given below.

5.3. Licences
Since 17 December 2001 Mac Telecom has a licence to use the wireless local loop in the 27.5-29.5 GHz frequency band.
Spectrum is still available for two licences for the entire Belgian territory in the 27.5-29.5 GHz frequency band. Since the part of the band reserved for radio relay links is not used yet, additional spectrum could be made free for the wireless local loop.
6. Procedure for granting the licences
The procedure for granting the licences is laid down in Article 31quinquies of the Royal Decree on the conditions for the establishment and operation of public telecommunications networks, inserted by the Royal Decree of 27 June 2000 and amended by the Royal Decree of 16 July 2001.
