If you simply wish to terminate a contract, you should take following elements into account:

If you have a permanent contract you can terminate it free of charge at any time.

You can personally choose the expiry date of your contract and communicate it to your operator in writing. Below you will find a number of model letters for terminating a contract.

You can decide to terminate your contract immediately and to inform your operator (by letter or - if the operator makes a specific number or address available - by SMS or e-mail).

The operator has to stop the service as quickly as technically feasible. The operator has to provide written confirmation of the discontinuation of the contract.

If you have a fixed-term contract, you can terminate it free of charge after six months.

You can terminate a fixed-term contract before six months have passed but the operator may claim compensation. The maximum compensation amounts to the subscription fee you would have paid if you had kept the contract till the end of the sixth month.

Mind you: If you have received a free or bargain price (piece of) equipment as part of the fixed-term or permanent offer you subscribed to, the operator is allowed to demand compensation. That compensation corresponds at most with the equipment’s worth at the time the contract is terminated, as stated in the repayment table annexed to your contract.

As a matter of fact, when you enter into a contract and as part of that contract you are given a piece of equipment for free or at a reduced price, the operator has to provide a repayment table, stating the residual value of that equipment for each month of the fixed-term contract or for maximum 24 months in case of a permanent contract. That value should diminish equally. That table has to be annexed to your contract.

Example: you have entered into a 12 month contract. When you signed the contract, you “bought” a device for € 1.

You decide to terminate the contract after 8 months.

The operator can demand a compensation of € 40.
