Consultation on the draft proposal by the BIPT concerning the fee for the shared use of an antenna site ("r-layer")

To ensure the coverage of their mobile services, operators must find sites on which to install their radio antennas.

The rules on antenna site sharing in Belgium seek to reconcile the requirements of competition effectively with the objectives of environmental protection, public health, public safety and spatial planning.

Operators are encouraged to attach their antennas, in so far as possible, to already existing supporting structures, such as building roofs, pylons and façades. In practice, operators combine the use of existing supporting structures with the construction of their own.

Where an operator owns a supporting structure at an antenna site, it must allow other operators to install their antennas on that structure.

The fee payable for such shared use is governed by the Act of 13 June 2005 on electronic communications ("the WEC").

The WEC entrusts the BIPT with the task of approving that fee.

This decision defines the calculation method, specifies which costs may and may not be included in determining the fee, and lastly sets the level of the fee that an operator may charge for an antenna site in its ownership that is made available to other operators.

Responses to this consultation must be submitted by 17 September 2026, following the procedure described on the first page of the annexed document.
